Rates, Terms & Conditions

Validity: January – March 2022

Route and transit

  • All conditions quoted Terminal – Terminal railway transport unless specifically stated:
  • Rotterdam (RSC Waalhaven) – Moscow crossing EU/ Customs Union border at Malaszewicze/ Brest
  • Transit time – 7 days
  • Operators are Smartcontainer B.V. for EU section of the train and RUSCON/ Transcontainer for Customs Union (Belarus and Russia) section

Capacity

  • Type of containers: 20/40/45 ft ISO + 20/40 ft tank containers
  • Train capacity – 44 x 40’’ (FEU) containers – including HC
  • Each FEU can be replaced with two 20’(TEU)s but only in pairs
Rates based on SOC containers:

Including:

  • Handlings Rotterdam terminal: train=> truck or truck=>train
  • Handlings in Malaszewicze: reloading train =>train
  • Handling in Brest: reloading train=>train
  • Handling Moscow terminal: train=> truck or truck=>train
  • Preparation of SMGS waybill for EB and CIM for WB trains
  • Information service: constant tracing with daily email updates.

Excluding:

  • Import/ Export customs clearance in EU and Russia
  • T1 termination/ATB and T1
  • Demurrage, overdue storage, addition handlings
  • Extra costs for customs/ fito/ vete inspection (extra handling, unloading goods)
  • Reexpedition
  • Container provision
  • Seals/ sealing: seals on each loaded container are responsibility of the customer. Please note the seal numbers.
  • Dangerous goods: extra termina costs

Invoices dated on the date of departure. Payment within 14 days

Documentation

Client provides:

  • packing list
  • export invoice
  • export declaration for each container with understanding that customs
  • clearance is responsibility of the client (brokerage service available separately at request)
  • loading list
  • electronically additional spreadsheet for SMGS
Terms & conditions:

Rates are net prices, valid per container and quoted in EUR(€)

Possible incurred costs will be forwarded to the ordering party

Transport orders are to be done in written through the booking form

The pricing presumes normal and unchanged transportation conditions and the continuing validity of the present costs, transportation charges, tariffs and currency ratios

Smartcontainer performs services as forwarder exclusively under the Terms and Conditions of “FENEX” (Netherlands Association for Forwarding and Logistics), latest edition and as amended from time to time, as published under www.fenex.nl/fenex-voorwaarden

General terms and conditions of Smartcontainer contractual partners only apply if expressly agreed. In addition, all relationship shall be governed by Dutch law. Any disputes between Smartcontainer and the client will only be submitted to the Court in Rotterdam.

CIM/SMGS/COTIF conditions for international railway transport

Booking & Deadline:

Booking: We need your order and documentation on 3 (three) weeks at latest for departure from Rotterdam to Moscow.

Delivery & Deadline:

Delivery deadline depends on the rules and regulations of each departure terminal. The information is to be coordinated at short notice upon request

Transit times and delivery dates are only guaranteed if agreed in advance in writing. Appointed times are based on the schedules of the services providers

Cancellation:
  • more than 7 calendar days (more than 168 h before departure): 30% of the agreed price
  • less than 7 calendar days (less than 168 h before departure): 50% of the agreed price
  • less than 48 hours: 80% of the agreed price
  • less than 24 hours: 100% of the agreed price
Container handling at the terminal:

Depending on the offer, the rate includes 2 to 4 operations. Additional operations due to unforeseen circumstances or upon request will be charged according to the rates of Rotterdam RSC and Moscow Terminal.

Weight of goods:

The client must specify every transport order in as much detail as possible. The exact weight and dimensions of the material to be transported must be specified, particularly the gross weight of the cargo, for which we refer to the SOLAS (Safety of Life at Sea) Convention that has been applicable as of 1 July 2016. For each CSC container loaded for an international journey/sea voyage, the correct VGM (Verified Gross Mass) must be specified so that the terminal, engineer, shipmaster or their representative can be notified in good time. Overdue notification may result in delays and additional costs.

Smartcontainer will not accept any liability in this matter. The maximum weight to be loaded depends on the transport route section. The maximum weight to be loaded will be specified in the quote submitted. Should these maximum weights be exceeded, this may mean that the container cannot be shipped. Smartcontainer cannot accept any liability for this either.

Free trade:

The offer only applies for the transport of goods that can be transported in accordance with free trade and standard commercial practice. This explicitly also refers to the HS codes that are contrary to transit through Russia because of the sanctions imposed. Smartcontainer is entitled to charge all costs charged by third parties as a result of incorrect information regarding the nature of the goods to be transported

Liability:

Smartcontainer has limited liability for errors or omissions on its part or that of third parties in performing the order.

Smartcontainer will never be liable for any indirect damage, including economic loss, consequential damage or immaterial damage.

Additional services

Other services (such as labeling of dangerous goods, sealing, document management, depot services, etc.) can be realized by Smartcontainer upon request.

  • Local deliveries in Moscow area when truck load can be matched with container weight

Special note on customs clearance

Please make sure that your importer to is able to customs clear your cargo within two days. Rail station will charge for containers not removed after this period.
