Opportunity Zones & Funds
American investors and companies have billions of dollars in unrealized capital gains that are sitting as 1's and 0's on computer screens that may never be realized or re-invested. Congress recognized this enormous untapped asset and, in 2017, led by Senators Tim Scott (R-SC) and Cory Booker (D-NJ and Representatives Pat Tiberi (R-OH) and Ron Kind (D-WI) created Opportunity Funds and Zones to allow these unrealized gains to be reinvested in low income American communities.
Investors receive tax benefits similar to a 1031 real estate exchange but applied to all types of capital gains. Developers and communities get access to capital that otherwise would not be available.
Established in the Tax Cuts and Jobs Act of 2017, Opportunity Zones are a new community development program to encourage long-term investments in low-income urban and rural communities nationwide.
Opportunity Funds provide a tax incentive for investors to re-invest unrealized capital gains, from any source, into a fund that is dedicated to making equity investments in businesses, real estate, and other business assets located in Opportunity Zones. The advantages to an investor are:
- A reduction in federal capital gains tax on any gain that is realized and then invested into an Opportunity Fund.
- No federal capital gains tax on gains generated by the Opportunity Fund (requires 10 year holding in the Opportunity Fund).
