The 4th amendment says this; "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized"
This amendment was created to prevent police searching houses and private property. Now, you must have evidence and a search warrant to search private property.
In 1985 there was a court case about the 4th amendment, New Jersey V. T.L.O. A female, 14 year old, student was caught smoking in the bathroom. She was later called to the vice principals office, she denied that she was smoking. The vice principals demanded her purse. In the students purse there was a pack of cigarettes, rolling papers, marijuana, a pipe, plastic bags, a large amount of money, and a list of students who owed her money. That evidence was used by New Jersey Juvenile Court and proved her guilty.
So, was the vice principal allowed to take her bag? Or was she protected by the 4th Amendment? The VP had every right to take and search her bag. The 4th amendment does apply at school, but can be 'taken away' for the safety of others. But for it to not apply, the school must have reasonable suspicion to search, in this case, a students purse without a search warrant.
