WHAT IS THE DIFFERENCE BETWEEN JUSTICE AND FAIRNESS?

Justice is the conformity to God's character. While fairness is the quality of making judgements that are free from discrimination.

Historical Foundations
The first written law: The Ten Commandments
The ten commandments
  • God gave the 10 Commandments from Mount Sinai to emphasize the importance of these laws.
COMMENTARIES ON THE LAWs OF ENGLAND
  • A work written by William Blackstone that provided a handy key to the English system of law.
  • It was the bestseller in America and it had a strong influence on the American Founding Fathers.
Who is William Blackstone?
  • Blackstone opposed the American struggle for liberty, his book probably restrained whatever urge American lawyers had to abandon the wisdom of the common law and strike out on their own to compile a legal code.
THE THIRD BRANCH: JUDICIAL BRANCH
district courts
  • By passing the Judiciary Act of 1789, the first Congress created a system of inferior courts and launched the United States Supreme Court as well. The act created thirteen district courts.
The supreme court
  • The United States Supreme Court is the third and highest tier of the federal judicial system and the most powerful court in the world.
Circuit courts of appeals
  • The circuit courts of appeals are the second tier of the federal judicial system. The Judiciary Act of 1789 established three circuits.
  • Circuit courts of appeals have appellate jurisdiction they do not hold trials but only hear appeals from the district courts in their circuits.
THE IMPORTANCE OF JUDGES

Judges interpret the law and enforce the rules. They are the decision-makers in the pursuit of justice in certain cases. They have to make decisions that is fair and unbiased without any regards to a side that is favorable.

Judges are like referees.
